Léo Heller, relator especial das Nações Unidas para o direito humano à água e ao saneamento e associado da ABES, ministrou, na segunda-feira, dia 19, a Palestra Magna do encontro com o tema “Saneamento básico como direito humano fundamental”.

Heller apresentou um resumo sobre as origens das normas legais que asseguram o direito humano à água e ao esgotamento sanitário. Foi citado o artigo 25 da Declaração Universal dos Direitos Humanos, de 1948, que afirma que “todo ser humano tem direito a um padrão de vida capaz de assegurar a si e à sua família saúde e bem-estar”. Além disso, os outros marcos legais citados por Heller foram o Pacto Internacional sobre os Direitos Econômicos, Sociais e Culturais, de 1966; a Convenção Internacional sobre os Direitos da Criança; a Convenção sobre a Eliminação da Discriminação contra as Mulheres e a Assembleia Geral das Nações Unidas, realizada em 2010 e em 2015.

O professor lembrou que os Estados-Membros das Nações Unidas reconheceram explicitamente o direito humano à água e ao saneamento na Assembleia Geral, e isso quer dizer que todas as pessoas, sem discriminação, devem ter acesso à água potável e ao saneamento.

Heller ressaltou que ainda há muito a ser feito para tornar este direito uma realidade para todos, para ter um mundo onde o acesso universal à água, ao saneamento e à higiene seja atingido por todos os que vivem, inclusive, em áreas não legalizadas.

Outro problema apontado durante a palestra é que, segundo o professor, o acesso à água segura e ao esgotamento sanitário não está disponível da mesma forma para homens, mulheres e outras identidades de gênero, de acordo com relatório da Organização das Nações Unidas (ONU) coordenado por ele. Outra constatação é que em quase todas as localidades onde há falta ou má distribuição de serviços de saneamento, são as mulheres que coletam água para manter a higiene do lar, o que as prejudica claramente.

Heller frisou que o estudo é importante para orientar políticas públicas voltadas para serviços de água e esgoto, pois, a legislação e as políticas públicas, quando são neutras em relação à questão de gênero, acabam favorecendo os homens.

A recomendação do relatório é que as políticas incluam mulheres e grupos marginalizados na tomada de decisões do planejamento e políticas e leis de saneamento, monitoramento e avaliação, além de sugerir que os governos criem um sistema de indicadores de gênero para melhorar a coleta de dados desagregados por sexo e outros fatores relevantes, que são necessários para avaliar o impacto e a efetividade das políticas que visam à igualdade de gênero e ao fortalecimento da fruição dos direitos das mulheres à água e ao esgotamento sanitário.

Relação entre saneamento, proteção dos mananciais e consciência ambiental

Na segunda, dia 19, a ABES-SP participou do painel especial “Relação entre saneamento, proteção dos mananciais e consciência ambiental”. Fernando Cintra Mortara, coordenador executivo da Câmara Técnica de Recursos Hídricos da ABES-SP, foi um dos palestrantes do painel, que foi coordenado por João Francisco Lima Neto, presidente da Assemae Regional Nordeste II e Diretor do SAAE de Campo Maior (PI).

Os outros participantes foram: José Yarley de Brito Gonçalves, presidente da Sociedade Anônima de Água e Esgoto do Crato (SAAEC/CE); Sérgio Antonio Gonçalves, diretor do Departamento de Recursos Hídricos e Secretário Substituto / Secretaria Nacional de Recursos Hídricos e Qualidade Ambiental do Ministério do Meio Ambiente; e Volney Zanardi Júnior, coordenador da Área de Administração da Agência Nacional das Águas – ANA.
