ANA divulga relação dos prestadores de serviços de água potável ou de esgotamento sanitário que apresentaram documentação de capacidade econômico-financeira

A Agência Nacional de Águas e Saneamento Básico (ANA) divulgou hoje, 11 de janeiro, a relação dos operadores que apresentaram a documentação exigida no § 2º, art. 11, do decreto 10.710/2021, que exige a comprovação da capacidade econômico-financeira dos prestadores de serviços de abastecimento de água potável ou de esgotamento sanitário. A publicação contribui para disponibilizar informações sobre o atendimento do decreto pelos prestadores dos serviços, que poderão ser acessadas pelas instituições federais para procederem suas atividades relativas ao repasse de recursos públicos para o setor de saneamento básico. 

O Decreto de avaliação de capacidade econômico-financeira, nº 10.710/2021, que estabeleceu a metodologia para comprovação da capacidade econômico-financeira dos prestadores de serviços públicos de abastecimento de água potável ou de esgotamento sanitário, com vistas a viabilizar o cumprimento das metas de universalização previstas no caput do art. 11-B da Lei nº 11.445, de 2007, institui a obrigação ao prestador de apresentar um rol de documentos para a comprovação da capacidade econômico-financeira.

Os operadores tinham até a data de 31 de dezembro de 2021 para encaminhar essas informações para as agências reguladoras responsáveis pela fiscalização de seus contratos, que efetuaram a avaliação. Após esse prazo, esses prestadores tinham a obrigação de apresentar à ANA, em até cinco dias úteis do encaminhamento à agência reguladora, cópia do protocolo do requerimento de comprovação de capacidade econômico-financeira acompanhado de cópia dos documentos enviados.

Com o objetivo de possibilitar a transparência e a legalidade do acesso aos recursos públicos da União, apresenta-se no Anexo 1 a lista dos operadores que entregaram a documentação à ANA, com a relação dos municípios, conforme §2º do art. 11 do decreto nº 10.710/2021, para amplo acesso da sociedade sobre a regularidade do atendimento e, especialmente, para o cumprimento do requisito de repasse de recursos por parte das instituições financeiras, conforme art. 50 da Lei nº 11.445/2007.

Vale ressaltar que a informação corresponde apenas aos prestadores dos serviços que apresentaram documentação à ANA, com autodeclaração exigida no processo de recebimento pela ANA, e que a decisão sobre a capacidade econômico-financeira do operador será feita por cada entidade reguladora competente, responsável por fiscalizar o respectivo contrato de prestação do serviço, até 31 de março de 2022. E após essa data, segundo o Art. 17 do referido decreto, a ANA deverá disponibilizar em seu sítio eletrônico, no mínimo, cópia eletrônica das manifestações técnicas e das decisões da entidade reguladora, ressalvadas as hipóteses de sigilo previstas em lei.
