Em dezembro do ano passado, umas das grandes conquistas do setor de saneamento no Brasil foi a aprovação pela Comissão de Desenvolvimento Urbano (CDU) da Câmara dos Deputados da criação do espaço permanente de discussão sobre saneamento básico. A iniciativa faz parte das 20 recomendações da SubÁgua (Subcomissão da Universalização do Saneamento Básico e do Uso Racional da Água), presidida pelo deputado federal João Paulo Papa (PSDB). Este é um dos temas abordados nesta entrevista com o parlamentar.
Papa fala também sobre crise hídrica, resíduos sólidos, Plansab e adiamento do prazo de entrega dos Planos Municipais de Saneamento Básico. E ressalta, ainda, a importância da ABES no cenário brasileiro.

ABES – A Subcomissão Especial da Universalização do Saneamento Básico e do Uso Racional da Água da Câmara dos Deputados (SubÁGUA) realizou diversas audiências, das quais a ABES participou. Como o senhor avalia o trabalho realizado?
João Paulo Papa – Foi um período muito produtivo: oito meses de trabalho, seis audiências públicas e uma visita técnica, com a participação de 12 instituições do setor, que ofereceram importantes contribuições. Colocamos luz sobre o tema na Câmara dos Deputados que, consequentemente, voltou à pauta nacional. O desafio agora é “manter a chama acesa” para que o Saneamento continue sendo tratado com a prioridade que merece. Nesse sentido, demos um passo muito significativo: ao final dos trabalhos conseguimos aprovar a criação da Subcomissão Permanente de Saneamento Ambiental. A partir de agora o setor tem, na Câmara Federal, um espaço próprio para discussões sobre os avanços necessários.
ABES – Como avalia a atual crise hídrica que atingiu diversas regiões do país e como essas propostas podem ajudar esse cenário?
João Paulo Papa – Embora o pior período da crise já esteja passando, ela deixa muitas lições para os setores público e privado e, também, à população. As ações na área de saneamento serão tratadas sob uma nova ótica: a dos fenômenos climáticos extremos. Esses fenômenos passarão a influenciar decisões do presente e do futuro, desde projetos até a gestão dos sistemas. E, além disso, trarão mudanças de cultura e comportamento na sociedade, que sempre terá um papel fundamental sobre as decisões a serem adotadas.
ABES – A crise hídrica colocou o saneamento de vez na pauta prioritária do Brasil. Por que, sendo o saneamento condição para a saúde e qualidade de vida, tem recebido mais atenção somente nos últimos anos?
João Paulo Papa – A crise hídrica causou um choque na sociedade e nos governos. Esse choque recolocou o tema, com maior ênfase, na pauta nacional. Além disso, nos trouxe lições que terão reflexos por muitos anos. Criamos uma nova consciência a respeito da importância e das limitações dos nossos mananciais e das carências de investimentos e de gestão. Essa é uma situação em que as dificuldades podem gerar novas oportunidades.
ABES – O Plano Nacional de Saneamento (Plansab) prevê grande avanço no atendimento dos serviços de saneamento básico – água, esgoto, resíduos sólidos e drenagem – num prazo de 20 anos. É um grande desafio. Como avalia o andamento do Plano e os principais obstáculos encontrados? Poderia também fazer um comentário sobre o Programa Saneamento Estruturante, que faz parte do Plansab e trata de criar melhorias na gestão do setor?
João Paulo Papa – O Plansab foi um grande avanço, um marco para o setor e, acima de tudo, para o Brasil. Porém, como constatamos durante as audiências realizadas na SubÁgua, o ritmo dos investimentos realizados não é suficiente para atingirmos a universalização no prazo programado. Ela somente será alcançada após 2050 e isso é muito ruim. Temos que reverter esse quadro de baixo investimento, seja injetando novos recursos do orçamento público, seja adotando novas estratégias que ampliem os investimentos por parte das concessionárias. O Regime Especial de Incentivo ao Saneamento Básico (proposta do senador José Serra aprovada no Senado, que foi relatada por mim na Câmara dos Deputados e tramita de forma avançada nesta Casa) é uma delas. As ações estruturantes previstas no Plansab, como o apoio à gestão; apoio à prestação de serviços; capacitação; assistência técnica e desenvolvimento tecnológico e científico, são fundamentais para a implementação e consolidação do saneamento ambiental nos municípios brasileiros. Estas iniciativas serão suportadas por recursos não onerosos do Governo Federal, e devem ser as primeiras ações a serem implementadas, tendo em vista que sem uma gestão adequada não será possível sequer mensurar a evolução do saneamento no Brasil.
ABES – Grande parte dos municípios brasileiros e mesmo das Companhias Estaduais apresentam claras dificuldades operacionais e financeiras, o que dificulta ou impossibilita a boa prestação de serviços de saneamento. O que o senhor acha que pode ser feito para melhorar esse cenário?
João Paulo Papa – Estes temas também foram abordados de forma objetiva pela SubÁgua. Entre as 20 recomendações apontadas destaco, por exemplo, o fortalecimento institucional do setor; estímulo a recursos para os planos municipais de saneamento; linha de financiamento para desenvolvimento operacional dos prestadores de serviços de saneamento; assistência técnica às cidades; aperfeiçoamento dos modelos de subsídios tarifários e não tarifários; adoção de política tarifária diferenciada de energia elétrica, entre outras ações. Nosso trabalho, a partir de agora, terá como foco a aplicação dessas recomendações. Melhorar a gestão é algo fundamental para o desenvolvimento do setor.
ABES – O Decreto n. 7.217/2010, que regulamentou a Lei n. 11.445/2007, prorrogou o prazo de entrega dos PMSB´s de 2010 para dezembro de 2013 ao estabelecer que a partir do exercício financeiro de 2014 a existência do plano seria condição para o acesso a recursos orçamentários da União (§2º, art. 26). Este prazo, porém, foi novamente prorrogado para o exercício financeiro de 2016 (Decreto Federal n. 8.211 de 21/03/14), passando valer a data final de entrega dos planos para 31 de dezembro de 2015. O Decreto vinculou ainda o acesso a recursos da União à existência de organismos de controle social até dezembro de 2014. O senhor acredita que este prazo será atendido pelos municípios? O que é possível ser feito no país, em sua opinião, para que as leis sejam efetivamente cumpridas?
João Paulo Papa – Os municípios brasileiros precisam de apoio técnico para que possam executar seus planos de saneamento, principalmente os menores, que enfrentam os maiores desafios nessa área. Esse também foi um tema tratado durante as audiências. Sem o devido apoio, muitas cidades não terão condições para concluir seus trabalhos. Defendemos a destinação de 5% do Orçamento da Secretaria Nacional de Saneamento Ambiental do Ministério das Cidades para financiamento da execução dos planos, até que todos os Municípios Brasileiros cumpram essa tarefa. Além disso, apoiamos a criação de um Programa Nacional de Assistência Técnica destinado aos titulares dos serviços públicos de Saneamento para garantir a necessária capacidade técnica e de gestão. Creio que essas duas ações, aplicadas em conjunto, podem ser decisivas para que os municípios possam cumprir aquilo que está determinado na lei.
ABES – Depois de 21 anos de tramitação no Congresso Nacional, a lei que institui a Política Nacional de Resíduos Sólidos (PNRS) foi sancionada em agosto de 2010. Porém, o fim do prazo para fechamento dos lixões completou um ano este mês, mas muitos ainda estão em atividade. O Projeto de Lei do Senado (PLS) 425, de 2014, adiou novamente a data definitiva para os municípios se adaptarem à Política Nacional de Resíduos Sólidos (Lei 12.305, de 2010) e fecharem os lixões. Como ajudar esses municípios a se adaptarem à nova lei?
João Paulo Papa – Creio que devemos seguir a mesma linha que ressaltei anteriormente: é preciso apoiar os municípios nessa questão. Falta estrutura e recursos financeiros para que o País alcance as metas estabelecidas, pois os avanços foram tímidos nos últimos anos. Criar programas e outros mecanismos que auxiliem os gestores municipais a elaborarem esses planos são medidas fundamentais.
ABES – O que o deputado pode falar a respeito da prorrogação do prazo para os municípios entregarem os planos municipais de saneamento para dezembro de 2017.
João Paulo Papa – Essa decisão, embora protelatória, resulta da falta de instrumentos e politicas adequadas para o necessário apoio técnico aos municípios. Como ressaltei anteriormente, defendemos medidas concretas nessa área, como a destinação de 5% do Orçamento da Secretaria Nacional de Saneamento Ambiental do Ministério das Cidades para financiamento da execução dos planos, até que todos os Municípios Brasileiros cumpram essa tarefa, e a criação de um Programa Nacional de Assistência Técnica destinado aos titulares dos serviços públicos de Saneamento.
ABES – A ABES atua no Setor de Saneamento Ambiental há 50 anos. Como o senhor avalia o esforço empreendido pela ABES e outras entidades para a universalização do saneamento no país?
João Paulo Papa – A ABES realiza um trabalho fundamental para o desenvolvimento do Saneamento Ambiental do Brasil. É uma entidade que reúne mais de 10 mil profissionais do setor, conhece a realidade de todas as regiões do País e tem autoridade e capacidade técnica para pautar todas as discussões sobre o tema. Têm o reconhecimento das mais importantes organizações nacionais e internacionais, como o BID, parceiro de diversas ações. As iniciativas da ABES têm sido a maior garantia de que a sociedade civil brasileira está devidamente representada na luta por avanços de um tema que é fundamental para a saúde, qualidade de vida e desenvolvimento humano.
